Renewable Resources

Anzarut & Holm acted as the legal advisor of the lead consortium partner, Sustainable Regional Australia Pty Ltd (SRA), in the Central Victoria Solar City program, part of the federal governmentŐs $94 million Solar Cities program promoting local energy generation. The consortium, also comprising Bendigo Bank, Origin Energy and Powercor Australia, secured federal and state government funding to build two separate solar parks, in Ballarat and Bendigo, in addition to creating a number of retail and business-focused energy efficiency products and services.

In advising SRA in the establishment of the consortium, Anzarut & Holm provided structural governance advice, drafted company constitutions and consortium agreements, as well as negotiating and liaising closely with the federal Department of Environment, Water, Heritage and the Arts, and on a state level, Sustainability Victoria, to complete project funding agreements.

Anzarut & Holm also provided advice across the gamut of commercial and regulatory issues for the project, including leases of greenfield sites, construction agreements, and power purchase agreements, as well as navigating through a variety of regulatory items, such as fundraising compliance items with ASIC and obtaining ACCC notification approval.

Competition Law and Regulation

Anzarut & Holm staff have worked for competition regulators before entering private practice and therefore have extensive experience in all aspects of competition law (antitrust) and regulatory enforcement. This allows us to provide practical and strategic legal advice aimed at assisting our clients to achieve their commercial goals, while minimising regulatory risk.
